Terms of Service

These Terms of Service govern your use of Vesper Audit, Vesper Inspect, and the vesperapps.com website (collectively, "the Services"), operated by Vesper Technologies LLC ("we", "us", or "our"), an Oregon limited liability company. By downloading, installing, or using the Services, you agree to these terms.
1. The Services
Vesper Audit is a desktop application for automated web accessibility auditing. Vesper Inspect is a Chrome browser extension for inspecting element-level accessibility attributes. Both tools are built and maintained by Vesper Technologies LLC.
2. License
We grant you a personal, non-exclusive, non-transferable license to install and use the Services for your own purposes, subject to these terms.
Free tier. Vesper Audit's free tier allows single-page scans with on-screen results at no cost.
Pro tier. A Pro license unlocks full site crawling, all export formats, suppressions, scan profiles, and other features listed on the pricing page. A Pro license covers two seats and is valid for one year from the date of purchase.
3. Restrictions
You may not:
- Sell, sublicense, or redistribute the Services or any license key
- Reverse engineer, decompile, or disassemble the Services
- Use the Services to build a competing product
- Share, transfer, or resell a license key to another person or organisation
- Use automated methods to circumvent the license activation system
4. Payment and renewal
Pro licenses are sold via Lemon Squeezy, who acts as the Merchant of Record for all purchases. Pricing, payment processing, and tax collection are handled by Lemon Squeezy under their own terms and privacy policy.
A Pro license is valid for one year from the purchase date. Renewal is not automatic - you will receive a reminder before your license expires. Continued use of Pro features after expiry requires purchasing a new license.
5. Refunds
Refunds are available within 30 days of purchase. See the refund policy for details.
6. Intellectual property
Vesper Audit, Vesper Inspect, the Vesper name, and all associated assets are the intellectual property of Vesper Technologies LLC. Nothing in these terms transfers any ownership rights to you.
7. Privacy
The privacy policy describes how data is collected and used in connection with the Services.
8. Disclaimer of warranties
The Services are provided "as is" without warranty of any kind, express or implied. We do not warrant that the Services will be error-free, uninterrupted, or that accessibility issues identified by the Services constitute a complete or legally sufficient audit. Automated tools identify a subset of accessibility issues - manual testing is always required for a thorough evaluation.
9. Limitation of liability
To the maximum extent permitted by law, Vesper Technologies LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms or your use of the Services shall not exceed the amount you paid for your current license period.
10. Changes to these terms
We may update these terms from time to time. Material changes will be announced via the in-app notice system or on this page. Continued use of the Services after changes take effect constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of the State of Oregon, USA. Any disputes arising from these terms shall be resolved in the courts of Oregon.
